HR 5717 represents a greater level of tyranny than this nation has ever seen. It is a threat to every law abiding citizen and destructive to the Republic itself. The idea that our Federal Government would even consider the implementation of far reaching firearms restrictions and “extreme risk protection orders” (Red Flag Laws) only demonstrates the extent to which those in positions of power have fallen from the foundations upon which this nation was formed. Our rights are not up for discussion. They are not subject to negotiation.
As Governor I will ensure that under no circumstances will we adhere to, or otherwise acknowledge, any legislation that is contrary to the supreme law of the land: the US Constitution. This is further supported by the Montana State Constitution and our Declaration of Rights, the legal contract by which Montana joined the Union of States.
Section 1. Popular sovereignty. All political power is vested in and derived from the people. All government of right originates with the people, is founded upon their will only, and is instituted solely for the good of the whole.
Section 2. Self-government. The people have the exclusive right of governing themselves as a free, sovereign, and independent state. They may alter or abolish the constitution and form of government whenever they deem it necessary.
Section 3. Inalienable rights. All persons are born free and have certain inalienable rights. They include the right to a clean and healthful environment and the rights of pursuing life's basic necessities, enjoying and defending their lives and liberties, acquiring, possessing and protecting property, and seeking their safety, health and happiness in all lawful ways. In enjoying these rights, all persons recognize corresponding responsibilities.
Section 12. Right to bear arms. The right of any person to keep or bear arms in defense of his own home, person, and property, or in aid of the civil power when thereto legally summoned, shall not be called in question, but nothing herein contained shall be held to permit the carrying of concealed weapons. (I don't like that last part)
Section 17. Due process of law. No person shall be deprived of life, liberty, or property without due process of law.
Section 19. Habeas corpus. The privilege of the writ of habeas corpus shall never be suspended.
Section 31. Ex post facto, obligation of contracts, and irrevocable privileges. No ex post facto law nor any law impairing the obligation of contracts, or making any irrevocable grant of special privileges, franchises, or immunities, shall be passed by the legislature.
Section 32. Civilian control of the military. The military shall always be in strict subordination to the civil power; no soldier shall in time of peace be quartered in any house without the consent of the owner, nor in time of war, except in the manner provided by law.

Those who believe that they can enforce unconstitutional laws against the People of Montana are sadly mistaken. The assault against our rights and the war on the American Citizenry ends now. This includes any existing or pending laws that are repugnant to those upon which this nation was founded, or by which Montana joined the Union. Any violation of this agreement is a Breach of Contract which would in turn call into question the very Union itself. The ongoing attempt to undermine our foundational values has gone far enough. The tyranny within rising up around us must be stopped now. Such actions are nothing short of Constitutional Heresy and represent willful action on the part of the Federal Government to override our collective will and supersede our laws in favor of the that of the "so called" elite.
I will reestablish all of our Constitutional Rights as originally written and intended without compromise or negotiation. We the People of Montana will not comply with unconstitutional or tyrannical demands. It would be wise for the Federal Government to take note and step back from the precipice upon which they stand.
